Friday, AG Merrick Garland used a fully weaponized Justice Department to purposefully, intentionally and willfully target the political opposition of the Biden administration. Worse still, the entire media apparatus knows this purpose and yet denies it. Our nation is in a very precarious place.

Via. Washington DC - Stephen K. Bannon was indicted Friday by a federal grand jury on two counts of contempt of Congress stemming from his failure to comply with a subpoena issued by the House Select Committee investigating the Jan. 6 breach of the U.S. Capitol.

Bannon, 67, is charged with one contempt count involving his refusal to appear for a deposition and another involving his refusal to produce documents, despite a subpoena from the House Select Committee to Investigate the January 6 Attack on the U.S. Capitol. An arraignment date has not yet been set in the U.S. District Court for the District of Columbia.

DOJ Office Of Legal Counsel: Matthew Whitaker Can Legally Serve As Acting Attorney General

In a move that supports President Trump, the U.S. Justice Department, Office of Legal Counsel (OLC), has released a lengthy memo outlining the legal support for the interim appointment of Matthew Whitaker as Acting Attorney General.

(Via Wall Street Journal) […] The Justice Department’s opinion is aimed at critics who say Mr. Whitaker’s installation is an invalid run around the Constitution’s requirement that the Senate provide “advice and consent” for senior executive-branch nominations. It comes a day after the state of Maryland asked a federal judge to block Mr. Whitaker from serving, arguing that job should fall to Deputy Attorney General Rod Rosenstein.

A judge Wednesday set a hearing on that argument for Dec. 19.

The opinion is likely to further the debate that has surrounded Mr. Whitaker since President Trump named him to replace Jeff Sessions, who was ousted last week. Even before Mr. Sessions’ resignation, the department’s Office of Legal Counsel had advised the White House that Mr. Trump could lawfully name Mr. Whitaker as his successor, a senior department official said Wednesday.

Blog Author's Comments: Finally some good news, I know very little about Mr. Whitaker, didn't even know he existed until President Trump appointed him, but I know this. If he scares the hell out the Democrats than he must be the man Trump needs. He knows the whole game and all the players.

But, the 9th circuit court of appeals has not yet spoken, and I assume could step in and temporarily shut President Trump's appointment down. The Democrats and liberals/progressives desperately want Deputy AG Rod Rosenstein to be the Attorney General. Small wonder because he is a member of the swamp. He appointed Mueller and all of the leftists do not want him and his group to stop digging, for anything they can twist to take down President Trump. AG Witaker could remove Rosenstein and oust Mueller and his people. But, will he...we shall see what transpires.

Tapper seemed clueless. He appeared to confuse the evidentiary basis on which the FISA warrant was sought by the FBI (the Steele ‘dossier’), and the event that lead to the FBI purportedly starting the investigation (the Downer/Papadopoulos meeting), two completely separate things. Jake Tapper stated he had spoken to several DOJ people who have basically told him Matt Gaetz doesn’t know what he is talking about. Who in the DOJ is speaking with Tapper about Republican lawmakers and the Special Counsel?

Jake Tapper could easily be lying when he made that statement. If he truly has someone in the DOJ that feeds him information, that person or persons should be outed, fired and prosecuted. Jill Stein is continuing her push to investigate the integrity of the U.S. electoral system, with lawyers for the former Green Party presidential candidate asking Attorney General Loretta Lynch to probe the issue.

“We write to urge the Department of Justice to launch an investigation into the integrity of our nation’s election system generally, and our nation’s voting machines specifically, based on the information we discovered in the course of this representation,” reads the letter from Stein’s counsel dated Friday.

“The attempted recount process has uncovered that voting machines relied on in these states and across the country are prone to human and machine error, especially in under-resourced black and brown communities, and vulnerable to tampering and hacking,” the letter continued.

“The recount also found that the states’ efforts to protect their systems may be insufficient, particularly in low-income communities and communities of color. Each of these grave concerns warrants federal intervention,” it added.

Obama Administration Lawyers Fight 'Redskins' Trademark

Washington Times -- The Washington Redskins’ name is commercial speech and isn’t the kind of free expression protected by the First Amendment, the Obama administration told a federal court this week in defending a ruling that has stripped the football team of trademark protections.

The team’s name itself is not at stake, but if the trademark is canceled, the name becomes less valuable because the owners would struggle to enforce their trademark against anyone who wanted to use the name or Indian logo on their own merchandise.

In a filing Monday, the Justice Department defended the Trademark Trial and Appeal Board’s decision last year to strip the team of protections.

“Not only do trademarks function only minimally as a vehicle for expression, but trademark registration also involves the necessary participation of the government in approving that registration, which confers relaxed First Amendment review even when combined with the speech of a private party,” the Obama lawyers said.

Trademark law says disparaging marks cannot be granted protections, and the government argues that the name has become disparaging over the last century. The trademark board, in its 2-1 ruling, also cited polling suggesting a significant percentage of American Indians consider the name a slur.

Pro-Football Inc., the company that operates the team, argues a previous court ruling has already held the trademark wasn’t disparaging.

Since the trademark has been used by the Redskins for many decades why is it now offensive? Politio44 -- Good-government advocates have sued the state of Florida, alleging its purge of non-citizens from voter rolls has swept up too many legally-registered African American and Latino voters and is undermining laws that ensure fair access to the ballot box.

The state chapter of the American Civil Liberties Union, the Lawyers Committee for Civil Rights and the local office of the international law firm of Weil, Gotshal & Manges LLP filed a federal lawsuit in Tampa, claiming that the state Bureau of Elections is breaking the law in its ongoing purge, designed to scrub voter registration lists ahead of the state’s August congressional primary.

Florida officials, according to the suit, are using outdated information and a badly-flawed process to conduct the purge, according to the suit. And the procedure, the advocates contend, requires lawful citizens and already legally registered voters to prove their citizenship or lose their ability to vote.

“Florida is flouting federal laws designed to protect voters from precisely this kind of action,” Bob Kengle, co-director, Voting Rights Project, Lawyers’ Committee for Civil Rights Under Law, said in a statement issued Friday. “The right of every citizen to have their voice heard at the ballot box is being threatened. The Lawyers’ Committee will continue to tirelessly fight any effort to make full-fledged Americans second-class citizens.”[...]

The Justice Department last month formally asked Florida to justify the move, warning that it might violate provisions in the Voting Rights Act and the National Voter Registration Act. In their response earlier this week, Florida officials insist the scrub is legal under both statutes, and would have happened much earlier in the election cycle if the Department of Homeland Security had allowed them to use a more expansive federal database for the comparison.

Liberals just hate to see their practice of trying to sway election results hampered. The law is clear, if you are not a citizen you can’t vote - it also requires that you be alive, seems fairly straight forward to me.

Has the ACLU ever done anything in favor of America? This is not a trick question. I have never heard of them doing anything that indicated a respect for America.

The Department of Homeland Security is also involved. (see link above) Florida Gov. Rick Scott said he will sue the DHS. Florida Secretary of State Ken Detzner produced the lawsuit, filed in Washington, D.C. district court on Monday, shortly after, along with a statement.

“For nearly a year, the U.S. Department of Homeland Security has failed to meet its legal obligation to provide us the information necessary to identify and remove ineligible voters from Florida’s voter rolls,” Detzner said. “We can’t let the federal government delay our efforts to uphold the integrity of Florida elections any longer."

In December, the department accused Arpaio of violating the civil rights of Hispanics since at least 2006 by unlawfully stopping, detaining and arresting them. Then, for months, Justice officials tried to negotiate a settlement aimed at correcting the violations. When negotiations fell through, the department threatened to sue.[...]

The standoff came to a head Thursday when the Justice Department announced it had sued Arpaio, his office and Maricopa County for civil rights violations, including what it says is the long-standing racial profiling of Latinos.

Assistant Attorney General for Civil Rights Thomas E. Perez said he was “left with no choice.”

“At its core, this is an abuse of power case involving Sheriff Arpaio and a sheriff’s office that disregarded the Constitution, ignored sound police practices and did not hesitate to retaliate against perceived critics in a variety of unlawful ways,” Perez said at a press conference in Phoenix .

The lawsuit against Arpaio and Maricopa County in an election year ratchets up the department’s battle with the states over civil rights, voting rights and immigration laws.

The Arpaio investigation is one of 17 probes the Justice Department’s Civil Rights Division has conducted of police and sheriff departments — the most in its 54-year history. At the same time, the civil rights division has blocked voter identification laws it says harm Hispanic and African American voters.[...]

Blog author's comments - Now a suit by the DOJ against Arizona Sheriff Arpaio. This is another chapter in the ongoing saga between the Obama administration and the state of Arizona concerning illegal immigrants. The Department of Justice already has one suit pending against Arizona and Gov. Jan Brewer, which was discussed recently by the Supreme Court of the United States. We should hear the outcome of this ruling possibly in June.

This latest suit against Arizona and this time Sheriff Joe Arpaio - this has also been a long battle - over the treatment of illegals by the sheriff. The Obama administration says that the civil rights of the illegals are being abused. I believe the sheriff is simply doing his job which he is paid to do. Because Arpaio refuses to obey and agree with the way Obama feels the illegals should be dealt with the DOJ will attempt to restrain him.

This is another political trick by the Obama regime pandering to the Hispanic/Latino vote. If anyone's rights are being violated it is the rights of the legal citizens of Arizona. Sheriff Arpaio is following the laws of our country. But, the Obama administration believes he is a deterrent against how they view the illegals -- as future Democratic Party voters.

Perhaps all of this may be a moot point depending upon how the Supreme Court rules next month.

CBS News -- For more than a year, CBS News has been investigating the Bureau of Alcohol Tobacco and Firearms' "Fast and Furious" operation and related cases that also employed the controversial tactic of "gunwalking." With Justice Department officials refusing all interview requests to date, CBS News requested numerous public documents through the Freedom of Information Act.

So far, all of the requests that have been answered have been denied in part or in full.

This week, we received a partial response to a request made more than a year ago. It asked for communications involving "Project Gunrunner," the umbrella program for Fast and Furious, from 2010 through April 2011. Specifically, it sought any communications to which any of the following top Justice officials were a party: Attorney General Eric Holder; Lanny Breuer, Assistant Attorney General for the Criminal Division; Kevin Carwile, chief of the Capital Case Unit; and Deputy Assistant Attorney Generals Bruce Schwarz and Kenneth Blanco.

The response includes mostly-blank pages.

For months, congressional Republicans probing ATF's Fast and Furious "Gunwalker" scandal -- led by California Republican House Oversight Committee Chairman Darell Issa -- have been preparing a contempt citation against Eric Holder over Fast and Furious.

If the DOJ will not provide the House Oversight Committee the information they have requested, why would CBS News think they would receive anything?

Perhaps -- but I have serious doubts -- the Oversight Committee will expose the hypocrisy and deceit of AG Eric Holder and the Department of Justice over operation 'Fast and Furious'.

I don't believe anything will come of this investigation, Fast and Furious will eventually fade away with no damage to AG Eric Holder or President Obama.

Blog author's comments - Is Sheriff Babeu going to be one of only a few to talk about this? My understanding of operation 'Fast and Furious' was supposed to prove the administration knew who the bad guys were - legitimate gun dealers in the Southwest - and set out to make them the heavies in a phony sting operation.

The operation was to permit straw purchasers to complete the weapon's purchase and move them to Mexico, in order to build a bigger case against Mexican criminal organizations suspected of being the ultimate buyers. The guns were supposed to be tracked but many were not. As a result the government does not know who has many of these guns.

Attorney General Eric Holder has said that he and other higher-ups at the Justice Department were not aware of the operation as it was being carried out.

At least one American lawman is dead because of this program that put firearms into the hands of Mexican drug cartels. And, supposedly 200 or more Mexican police, soldiers and civilians have been killed.

Congressman Issa is calling for a special investigator. But, more Republicans need to speak out until the situation is resolved. The GOP should make 'Fast and Furious' a campaign issue.
