Daily Caller -- President Donald Trump declared he would get a repeal to the Affordable Care Act by executive order if he needed early Tuesday morning.
“Since Congress can’t get its act together on HealthCare, I will be using the power of the pen to give great HealthCare to many people – FAST,” the president tweeted, suggesting that an executive order is on the way that will address health care.
The House of Representatives passed a measure that would have repealed the bill nationally known as Obamacare over the summer, but the Senate remains unable to pass legislation.
The latest Senate initiative sponsored by Sens. Lindsey Graham and Bill Cassidy was universally condemned by Democrats, and Republicans like Sen. John McCain asserted they would never support the measure.
The president reportedly reached out to Senate Minority Leader Chuck Schumer last week in an attempt to work out a deal on health care, but if the president is considering unilateral action on the matter, it’s likely the conversation produced little real movement on the issue.
Blog Author's Comments: The ACA is an awful law. But, it cannot be done away with by Executive Order. Congress should do their job. If they would vote to repeal it and stop funding it (imposing the many different taxes that are paid by all of us) Obamacare would eventually be gone. The Affordable Care Act is an extremely convoluted healthcare law and system. Depending upon which state you reside in you can receive terrible coverage or semi-terrible coverage and the cost to those who have it continues to rise. President Trump can toss out any executive order made by Obama, and likely should. And he can make an executive order as to a law if it’s ‘clarifying.’ But he cannot legally make an executive order that repeals Obamacare any more than Obama with his ‘pen and phone’ could create or change law.
It does not matter if it’s a favorable result, its counter to the Constitution. A majority of those with health insurance prior to Obamacare were satisfied with their existing plans, the ones Obama lied to and told them 'if you like you healthcare you can keep your healthcare'. How many of those people were able to keep their plans? What the Obama administration expected, was that the ACA would evolve into, was a Medicare or Medicaid type plan with many receiving it and paying nothing for it.
It does not matter what Trump comes up with. The Democrats will always find a leftist judge to block whatever he may do. The same as they did on immigration. It will be appealed to the ninth circuit, they will overturn in spite of the law and it would then go to the Supreme Court. It is a disgrace, that no matter what the president does, Senator John McCain will disagree with him along with Senators Susan Collins and Lisa Murkowski. Members of his own party want him to fail and allow much of the country to continue in disarray just for spite, as long as it pleases them.
