Liberal Judges Of US Appeals Court, Rule Trump 'Sanctuary Cities' Executive Order Is Unconstitutional

A U.S. appeals court ruled Wednesday it is unconstitutional for the Trump administration to threaten to withhold funding from “sanctuary cities” that aren’t cooperating with immigration officials.

"Absent congressional authorization, the administration may not redistribute or withhold properly appropriated funds in order to effectuate its own policy goals," Chief Judge Sidney Thomas wrote for the majority.

In a 2-1 ruling, Thomas also said he's sending back the case back to the lower court because there wasn't enough evidence to support a nationwide ban on Trump's executive order. The case will receive more hearings on the nationwide ban question.[…]

A federal judge also ruled last Friday that the U.S. Justice Department cannot withhold grants from Chicago because it was providing sanctuary to immigrants.

Trump promised to crack down on sanctuary cities, claiming they were “harboring” illegal immigrants. The administration said the executive order signed in January 2017 only applies to a small monetary fund that already requires compliance with immigration law.

Blog Author's Comments: The reasoning is demented. If their argument was true, then the executive branch could never make any grant decision and would need to have approval from Congress for every expenditure. The government would grind to a halt. The left wing, indoctrinated lawyers from the so-called institutions of higher learning, become judges and this is what we end up with. Surprise, Judge Sidney Thomas was appointed by democrat President William Jefferson Clinton.

So, I assume for now this is on hold until a case can wind it's way to the Supreme Court. Meanwhile, more illegals will be sheltered, many committing crimes, taking the states and government's money, which is our money and do what they want to do with the help of the liberal officials in the sanctuary cities and liberal judges. This is all being done with the sole purpose of stopping President Donald Trump at every turn they can, while risking the lives of so many legal citizens.

argusleader.com - A bill has been introduced in the South Dakota legislature that would require all able-bodied residents to purchase a firearm, the Argus Leader reports.

The measure, which would take effect on January 1st, 2012, would give all South Dakotan adults 6 months to acquire a gun “suitable to their temperament, physical capacity, and preference.”

According to the bill’s sponsor, Republican state Rep. Hal Wick, the bill has no chance of passage. He says he introduced it to prove that last year’s federal health care law is unconstitutional.

“Do I or the other cosponsors believe that the State of South Dakota can require citizens to buy firearms? Of course not,” he said. “But at the same time, we do not believe the federal government can order every citizen to buy health insurance.”

As the column states Rep. Hal Wick knows the bill has no chance of passing. He is doing this to show what most of us except for the Democrat Party know, the federal health care law is unconstitutional.

This comes on the heels of a ruling by Justice Roger Vinson of the U.S. District Court in Pensacola, who yesterday declared the primary mechanism whereby the health reform achieves universal insurance coverage–the individual mandate–is unconstitutional.

He ruled: “Because the individual mandate is unconstitutional and not severable, the entire Act must be declared void."

The Republicans in Congress, as a matter of strategy, must be ready for the Supreme Court to overturn Judge Vinson. That's why they must do what they can to repeal the entire Obamacare law.
