Judge Col. Nance - Lets Traitor Bowe Bergdahl Walk Free...


Townhall -- After facing life in prison, Army Sergeant Bowe Bergdahl is a free man after Judge Col. Jeffery R. Nance ruled Friday he will not face hard time for abandoning his fellow soldiers in Afghanistan and walking off his post eight years ago. He will lose his rank, be dishonorably discharged from the Army and be forced to forfeit $10,000 in payments. Prosecutors argued for a minimum of 14 years in prison. He faces none.

Bergdahl's trial, which took place at Fort Bragg in North Carolina, ended last week. He plead guilty to desertion and misbehavior in front of the enemy. After seeking out the Taliban, the terrorist group held Bergdahl captive for five years. He was traded for five high profile GITMO detainees in May 2014 by President Obama.

The wife of a soldier who was shot in the head and left with a traumatic brain injury while looking for Bergdahl testified in the sentencing phase in hopes of a harsh penalty and consequences.
National Guard Master Sgt. Mark Allen was on a mission with other US and Afghan troops to gather information in two villages in July 2009 when they were ambushed by insurgents using small arms, machine guns and rocket-propelled grenades.

Allen was attempting to make a radio call when he was shot near the temple. He suffered a traumatic brain injury that left him unable to speak, in need of a wheelchair and dependent on assistance for such everyday tasks as getting out of bed.
As a last resort, Bergdahl issued an apology at the end of the trial, saying he was sorry for putting others at risk in their efforts to find him. Six U.S. soldiers were killed looking for him: Staff Sergeant Clayton Bowen, Private 1st Class Morris Walker, Staff Sergeant Kurt Curtiss, 2nd Lieutenant Darryn Andrews, Staff Sergeant Michael Murphrey and Private 1st Class Matthew Martinek.

During an interview earlier this year, Bergdahl claimed he was treated better by the Taliban than the U.S. Army.

In closing arguments, defense attorneys argued that Bergdahl already had suffered enough confinement during five years of brutal captivity by Taliban allies. They asked the judge for a dishonorable discharge and no prison time. Their argument for leniency also cited harsh campaign-trail criticism by Donald Trump and Bergdahl's mental disorders.

Capt. Nina Banks, a defense attorney, said it wouldn't be justice to rescue Bergdahl from the Taliban "only to place him in a cell" now. "Sgt. Bergdahl has been punished enough," Banks added. "Sgt. Bergdahl paid a bitter price for the choices that he made."
The judge also considered comments made by President Trump about Bergdahl.
President Trump’s harsh criticism of Sgt. Bowe Bergdahl, who walked off his Army post in Afghanistan in 2009 and was captured by the Taliban, will weigh in favor of a lighter sentence for the sergeant, a military judge said on Monday.

“I will consider the president’s comments as mitigation evidence as I arrive at an appropriate sentence,” the judge, Col. Jeffery R. Nance of the Army, said during a hearing at Fort Bragg.

Blog Author's Comments: So, I have to believe that liberal Judge Col. Jeffery R. Nance is a NeverTrumper. Bergdahl had best go into hiding, someone is going to be looking for him, to do what the military failed to do. I am having serious reservations about what core values some of the people in the Army are teaching soldiers and the vetting process that they all go through. From Major Hasan who killed 13 people and injured 30 others in the Fort Hood mass shooting and should have been executed, to the recent known communist West Point graduate. And now a military judge giving this extremely soft punishment to a traitor, who in reality is responsible for the killing and injuring of the other soldiers who were looking for him.

But I have no doubt, for every lousy and heinous member of the armed service, there are 1000 or more real men and a few women doing heroic things under incredible conditions. The judge should face a court martial for the travesty that he is guilty of. He must be another of Obama's loyal patriots. We need a lot more citizen and military outrage if that sentence stands. Bergdahl should have gotten life for every man who was hurt or killed looking for him.

So let me attempt to get this straight, 6 dead honorably-serving servicemen, at least 1 permanently disabled serviceman, 5 high value Taliban scumbags for Bergdahl. And then he walks away a free man after pleading guilty to charges that should have carried a life sentence. A total disgrace and this makes no sense at all. Liberals continue to do their best to destroy this country. This military judge, was supposed to have served honorably since 1982. But, all serving officers serve honorably up until the point they do not. Then they are removed, and this is what should by all means happen to judge Jeffery R. Nance.

Bowe Bergdahl’s father praised Allah when he said “Bismillah ir-Rahman ir-Rahim” —which means “In the name of Allah, most Gracious, most Compassionate.”

The Taliban Five – Mohammad Fazl, Mohammed Nabi, Abdul Haq Wasiq, Mullah Norullah Nori, and Khairullah Khairkhwa – were freed from Guantánamo in exchange for Bergdahl.

"Mohammed Fazl is one of the first freed Guantanamo detainees to be retained from Afghanistan, accused by the UN of committing war crimes, and suspected of taking part in the slaughter of thousands of Shiite Muslims.

Mohammad Nabi, the former chief of Taliban security, arranged cooperative offenses with Al Qaeda, according to declassified files.

Abdul Haq Wasiq, a deputy to the deceased Taliban chief, Mullah Omar, was one of the top intelligence officials for the jihadi leader. He arranged training with top Al Qaeda operatives.

Mullah Norullah Nori is a senior Taliban commander who is also wanted by the UN for war crimes, and also took part in the suspected mass killing campaign against Shiites.

Khairullah Khairkhwa, a Taliban commander, has ties to the Ayatollah’s regime in Tehran. He was reportedly trusted by Taliban chief Mullah Omar to negotiate ties with Iran.

On May 31, 2014, President Obama appeared with Bergdahl's parents in the White House Rose Garden where he delivered a speech about the prisoner swap that resulted in the recovery of their son. The Obama administration traded five known terrorists for a traitor. Is it not yet clear - for the nonbelievers - that Obama is and always has been anti-American? Wake up Democrats and Clinton voters. We lost at least six brave soldiers in the hunt for Bergdahl, many more were wounded for this guy who threw down his gear and walked off in the dead of night, to join the Taliban terrorists.

The soldiers in 2nd Platoon, Blackfoot Company later mentioned Bergdahl's stated desire to walk away. Obama's decision like most of his others was inexcusable. He reversed a decades-old precedent of never negotiating with terrorists. It would be bad enough if Bergdahl was an honorable serviceman, but now we know he was at best a deserter and at worst a defector. He has pleaded guilty to the charges and could face the rest of his life in prison. To understand Obama, if you desert America, you have served with honor and distinction. Obama used a deserter as an excuse to release 5 terrorists that should never have been free again. If we had a real media in this country, they would be asking Obama why he did this. Trump described Bergdahl as a traitor during his presidential campaign. The guilty pleas by Sergeant Bergdahl, now stationed at an Army base in San Antonio, were not part of any deal with prosecutors and it will be up to an Army judge at Fort Bragg to decide his punishment.

The desertion charge carries a potential five-year sentence and the charge of endangering troops — formally known as misbehavior before the enemy — carries a potential life sentence. In a military courtroom Sergeant Bergdahl stood before the judge, Col. Jeffery A. Nance. “You just walked away?” Colonel Nance asked him. Sergeant Bergdahl was captured by Taliban militants within hours of disappearing from his remote outpost. Army prosecutors say that Sergeant Bergdahl’s departure from the outpost forced the military to drastically alter its operations and strategy during the manhunt, hurting the war effort.

Mark Steyn: President Knew The Truth On Bergdahl


Truth Revolt -- With all the media chatter about the findings in the Bowe Bergdahl investigation, author, columnist and Rush Limbaugh fill-in host Mark Steyn writes that there is no way President Obama and his staff could not have known the truth about Bergdahl last year.

When others objected, the White House dispatched the National Security Advisor, Susan Rice, to tell the American people that Bergdahl "served the United States with honor and distinction". She surely knew, as did the President, that that was a lie.

Given the background checks an ordinary law-abiding citizen requires these days merely to be permitted to be in the presence of the President, the White House must also have known that the man Obama embraced in the Rose Garden that day - Bergdahl's father - was a Taliban sympathizer.

Steyn cites extensively from his columns, written last June, including details of email exchanges between Bergdahl and his father. He also puts a fine point on what Obama's celebration of Bergdahl's release really means.

Obama didn't just trade five high-value Taliban leaders-cum-war criminals for one American deserter, but he chose to honor that deserter as an American hero. And, in so honoring him, dishonored all the comrades he deserted.
Blog Author's Comments - Obama had to have known the truth about Bergdahl. He had to know that Bergdahl was a deserter. For years his fellow soldiers were forced to stay silent about the disappearance and search for him. This should outrage every American veteran and active duty military member. The fact that Obama traded five terrorists for a deserter without alerting Congress before the prisoner swap occurred should outrage every American.

Obama has sat on his hands while ISIS took over the Middle East. He has squandered all gains from Iraq and Afghanistan. Bowe Bergdahl has finally been charged as a deserter, but I expect over time he will receive a full presidential pardon. And neither Obama nor anyone in his administration has mentioned the soldiers who were killed by the enemy while searching for this traitor.
