Charge Dismissed Against Student Who Refused To Remove NRA Shirt

Fox News -- The West Virginia eighth-grader arrested after refusing a teacher's demand he remove a National Rifle Association T-shirt he wore to school won't face criminal charges after all.

Jared Marcum, 14, was charged with obstruction following the April 18 incident after police who were called to Logan Middle School school said he refused to stop talking. The case generated national headlines, as Marcum's family and attorney, Ben White, claimed the demand that he remove the NRA shirt violated his right to freedom of speech. On Thursday, Logan County Circuit Judge Eric O'Briant signed an order dismissing the charge.

Marcum's mother, Tanya Lardieri, told WOWK that she was overcome with emotion after signing a dismissal order relating to the charge. The boy’s father, Allen Lardieri, said the couple is just glad Eric’s legal troubles are behind him.

"It should have come sooner but it's done and we don't have to have that concern anymore about him having a criminal record,” Allen Lardieri told WOWK. "I'm just glad that it's over. His mother is glad it's over.

After he was charged, Marcum faced up to a year in jail and a $500 fine. Although the charge related to the boy's behavior after the incident began, White said the school's unreasonable demand that he take off the shirt caused the situation to get out of control.

"We at this point believe that Jared acted as mature as a 14-year-old child can act with the pressure that was put on him," White told The Associated Press.

The school's dress code gives wide enforcement discretion to educators.

“If in the judgment of the administration, a student is dressed inappropriately, the student will be required to change clothes or cover up inappropriate clothing before returning to classes,” the code reads.

After Marcum was arrested, students throughout Logan County wore similar NRA shirts in a show of solidarity. And on Monday, the boy was summoned back to court as prosecutors sought to have a gag order imposed on him and his family. They claimed Jared and his father talking to the press about the case was not in the boy's interest, a rationale his own attorney rejected.

"We were here because the prosecution filed a motion for a gag order," White said on Monday. "My opinion is because, seemingly, they want to take it out of the court of public opinion."

But on Thursday, after reviewing statements from the arresting officer and the school's principal, White said he and a prosecutor agreed that creating a criminal record for Marcum wasn't a good idea.

"I didn't think it would go this far because, honestly, I don't see a problem with [the shirt],” Jared Marcum told WOWK in April. “There shouldn't be a problem with this.”
Blog author's comments - Would anyone care to prove that the wearing of this shirt caused a disturbance in the classroom other than the "adults" response to it? There was no mention that any of his classmates were offended or upset by the NRA shirt.

Many people...and apparently some at the Logan Middle School...wrongfully believe that the National Rifle Association is a harmful group, which somehow promotes gun violence, simply because of their defense of the Second Amendment. This thinking was extremely elevated after the liberals and the Obama administration focused on the NRA saying that they should share some responsibility for the tragic shooting at the Sandy Hook Elementary School in Newtown, Connecticut.

First Desertions From Bloomberg's Anti-Gun Group

Washington Examiner -- New York City Mayor Michael Bloomberg's group Mayors Against Illegal Guns, under fire for listing one of the Boston Marathon bombers a gun violence victim, is facing its first desertions from mayors who claim he has gone too far to target critics and legal weapons.

Two mayors, one from Nashua, N.H., and another from Rockford, Ill., northwest of Obama's Chicago hometown, have quit the group as it embarks on a campaign to shame lawmakers who voted down the recent Senate bill to expand background checks.

Nashua, New Hampshire Mayor Donnalee Lozeau quietly left in May, claiming that Bloomberg's group wants to ban legal weapons, far beyond its initial plan and name. She also said that the group's $2 million assault on New Hampshire Sen. Kelly Ayotte for voting against the Senate bill was unfair, according to New Hampshire Union Leader.

Rockford, Illinois Mayor Larry Morrissey quit Mayors Against Illegal Guns because it is pushing for a ban on assault weapons and large magazines, both legal. "As the original mission swayed, that's when I decided it was no longer in line with my beliefs," Morrissey told a town hall meeting, according to Rockford Register Star.

While far from a trend in a group of over 750 mayors, news of the resignations came after Bloomberg's group was whacked when it listed Boston Marathon terrorist Tamerlan Tsarnaev a victim during a rally against Ayotte in New Hampshire last week.

Entire column...

Blog author's comments - Some of the mayors must not be polling well because of their affiliation with Bloomberg. He is a fanatical little man on many things and he believes he knows what is best for all American citizens. Mayors Against Illegal Guns...the way they present their language is annoying. What mayor isn't against illegal guns?

We know that Bloomberg would like to take away all guns, but he can't say that. Instead of going after the gangs and criminals who are using illegal guns, what they have proposed will only affect law-abiding gun owners. Bloomberg and pro-gun control lawmakers are intent on looking for ways to keep the Second Amendment alive in the news and in Congress, but this isn’t the type of news they were looking for. Hopefully many more mayors will leave this group.

Blog author's comments - Is Edward Snowden a whistleblower or a traitor? That is for you to decide. If you watch the first video he seems to be an intelligent person who worked as a contract employee at the National Security Agency and disagreed with what they were doing.

Should he have gone to a U.S. government agency and told them what he knew and thought about the NSA program? I am not sure this would have helped his personal cause. Do you disagree with him for supposedly allowing (he may not have had a choice) China to access the data on the computers he had in his possession?

He will eventually be back in the United States to face whatever happens to him. But he may never live in the U.S. as a free man after leaking information about the NSA surveillance program. He undoubtedly had to know the ramifications of his actions.

Deceit From Both Parties On Immigration Bill

Repackaged Amnesty Bill Allows Napolitano To Nix Border Fence

Breitbart -- Another loophole inserted into the new version of the "Gang of Eight" immigration bill allows Department of Homeland Security Secretary Janet Napolitano (or any of her successors) to nix the construction of a required border security fence if she does not find it to be an "appropriate" use of resources.

Corker Amendment Permanently Offers Citizenship To Those Overstaying Visas

Breitbart -- Just as public anxiety about the weak border security provisions in the Senate imigration bill was building, GOP Sen. Bob Corker stepped forward with an amendment to "fix" the problem. The result of his efforts, however, has been a "Christas tree" measure, covering items far beyond border security. Breitbart News has learned exclusively that one provision of Corker's amendment will allow workers who stay in the country past their visa will remain on the "path to citzenship."

Casino Kickback: Reid, Heller Slip Vegas Tourism Handout Into Immigration Bill

Breitbart -- Senae Majority Leader Harry Reid (D-NV) and Sen. Dean Heller (R-NV) have inserted a provision that amounts to little more than a handout to Las Vegas casinos into the repackaged immigration reform bill, Breithabt News has learned. This provision, a brazen example of crony capitalism, was inserted into the immigration law enforcemant section of the bill despite the fact that it has nothing whatsoever to do with "immigration" or "law enforcement."

Blog author's comments - - The above three columns show it is politics in Washington as usual. The immigration reform/amnesty bill would be a huge gain for the Democrats and a devastating loss for the Republican Party. When the 11 million plus illegals become legal, and eventually given citizenship and are able to vote, the GOP will never again win another presidential election.

Again I say...close the borders and hire many more border patrol agents. Whenever that is complete and the borders secure than talk about immigration reform. Why the members of the Republican Party do not understand this is beyond me. If this bill makes it through the House it is over for the GOP. Many members of the Senate are ready to vote for this bill without even reading it.

Ted Cruz Launches National Petition Against Gang Of Eight's Bill

Breitbart -- Sen. Ted Cruz (R-TX) launched a national petition on Thursday to stop the Senate Gang of Eight's amnesty bill and send Washington a "strong signal" of the grassroots opposition to the bill.

"This is urgent," Cruz wrote in an e-mail to supporters. "We must stop this Gang of 8 immigration bill, which would give amnesty to an estimated 11 million illegal immigrants with no guarantee of a secure border."

"The Senate debate is in the final stages and we need to send Washington a strong signal of the overwhelming grassroots opposition to this amnesty bill from Americans across the country," Cruz explained.

Cruz urged supporters to share the petition with friends and to "act now--without delay--to help us defeat amnesty and stand for legal immigration!"
Blog author's comments - Is Ted Cruz the only person making sense in D.C.? It certainly seems like it. The passage of the amnesty bill being pushed by the 'Gang of Eight' and the Democrats will of course mean the demise of the Republican Party. This is exactly what Obama had envisioned when this began.

As I have said before...the only bill that I think should be voted on and passed now is to complete the border fence and hire many more border patrol agents. Until the border is secure, immigration reform should not even be addressed. The Republicans in no way will benefit from giving the illegals amnesty. The majority of the Hispanic people will never vote for the Republican candidates.

If the bill that the Gang of Eight, the Democrats, and some Republicans want is passed it will also mean more of a drain on the government coffers (taxpayers) so it will be a loss for the GOP and the U.S. If the Republican Party stopped this bill they...in my opinion...would gain many votes in the midterm elections of 2014. This is because I don't believe the majority of the voters want to make the illegal immigrants legal. If they want to become citizens of this country we already have laws in place for them to follow.

Furious Republican Rips Marco Rubio

WND -- Rep. Dana Rohrabacher, R-Calif., is ripping Sen. Marco Rubio, R-Fla., and other Republicans for facilitating the Democratic approach to immigration reform and deceiving the American people about what’s in the legislation.

Rubio stated repeatedly in recent weeks that effective border security was essential to getting his vote for the final version, despite his role in drafting the original bill. Earlier this week, however, Rubio told a Univision audience, in Spanish, that the effort to legalize the millions of illegal immigrants in the U.S. was the top priority.

“Let’s be clear,” Rubio said. “Nobody is talking about preventing the legalization. The legalization is going to happen. That means the following will happen: First comes the legalization. Then come the measures to secure the border. And then comes the process of permanent residence.”

Rohrabacher is not impressed.

“Rubio is so mixed up and so confused. I think he has given up his rightful place to advise any of us in Washington what to do, and he’s given up any right to be trusted by the American people,” he said.

Rubio tried to clarify his comments by saying that effective border security would be needed to trigger permanent legal status or citizenship for current illegals, but that temporary legal status would be conferred as soon as the bill is passed.

“This is just a lot of weasel words that Rubio and these people are throwing in. They’re going to legalize the status of people here illegally. Once they do that, that is an amnesty. And once they do that, there will be no border security improvements. It’ll all be a facade,” said Rohrabacher, who warned this bill would only attract tens of millions more illegal aliens.

Also this week, the Senate voted down an amendment to the immigration bill by Sen. Chuck Grassley, R-Iowa, that would require border security to be in place before any legal status is given to illegals. All four Republicans in the Gang of Eight voted against the amendment.

“That shows you exactly what the intent of the people pushing the legislation is, the fact that they couldn’t put legitimate triggers into the bill so we’d be able to determine whether the more had been made more secure. So the fact they had to vote that down in the Senate shows you that they’re not serious and they’re lying to us when they say otherwise,” said Rohrabacher, who vowed he will not vote for any bill that legalizes the status of anyone who came to this country illegally.

But it’s not just the Republicans in the Gang of Eight who are pushing the GOP to get behind the bill. Rohrabacher revealed it’s coming from all angles.

“We have been in an era of massive propaganda and pressure on each and every one of us, from the big-moneyed interests in our districts who want cheap labor to the liberal news media that want to further the cause of the liberal left. They’ve been pushing, pushing, pushing,” Rohrabacher said.

House Speaker John Boehner said immigration reform is his top priority and may not necessarily demand a majority of support from Republicans before bringing a bill to the floor. But Rohrabacher said that would be completely unacceptable.

“I would consider that a betrayal of the Republican members of the House and a betrayal of Republicans throughout the country,” he said. “If Speaker Boehner moves forward and permits this to come to a vote even though a majority of Republicans in the House oppose whatever is coming to a vote, he should be removed as speaker.”

Roohrabacher also fears House and Senate leaders may try to ram this bill through before summer recess, giving members little time to read the bill and Americans no chance to confront their lawmakers over the break. He said doing that would be a “declaration of war” against opponents of legalization and a “betrayal of the American people.”
Blog author's comments - The Republican Party needs more people like Rep. Rohrabacher. I am quite tired of hearing Sen. Marco Rubio talk about the passage of immigration reform for the illegals. I don't know if I ever saw a new Senator become a RINO faster than Rubio has. He has lost all trust I may have had in him. He has also done harm to his future political career but that does not matter to me. What I do care about is what the passage of an immigration reform bill will do to the country. It is a quick pathway to citizenship for the illegals.

Also, Speaker John Boehner wants to pass an immigration reform bill in the House. Unless the House Republicans balk at this and refuse to allow the party to commit political suicide, which is what this is, the Republican Party will never elect another president. What is so maddening is that the 'Gang of Eight' in the Senate and Speaker of the House Boehner can't see what they are doing and are fast tracking this.

Many Republicans believe if they do not pass an immigration reform bill they have no chance in the election of 2016. What they should be doing is concentrating on holding the House and picking up seats in the Senate in 2014 with the midterm elections. The majority of Hispanic people will never vote for the candidates of the Republican Party. They have not so far so why do the GOP legislators believe this will change? Lastly, border security will never happen. If I were a legislator I would want secure borders first before immigration reform is ever discussed.

Biden To Restart White House Guns Push

Politico -- Vice President Joe Biden will try to restart the dormant gun control push next week with an event to tout the administration’s progress in combatting gun violence.

The June 18 White House event will mark the first time Biden or President Barack Obama has held a public event on gun control since the Senate rejected expanded background checks for gun purchases April 17.

Despite Obama’s saying “this effort is not over” after the Senate defeated expanded background checks, the White House has since done little to push its gun control proposals.

The event comes, according to an invitation shared with POLITICO, as “the Administration continues to implement President Obama’s plan to protect our children and communities by reducing gun violence.”

A Biden aide confirmed a gun control event has been scheduled but declined to discuss what will take place. The White House declined to comment.

Obama won’t be in attendance. He will be at the G-8 summit in Northern Ireland, one of two overseas trips he’s making this month.
Blog author's comments - I knew they wouldn't let it go. They are gearing up for another assault. Perhaps they think the legislators will get tired of dealing with it coming up again and eventually pass something just to take it off the table. It's a wearing down process. If Obama could rewrite the Second Amendment he would.

Obama has told Biden to ask the liberal mainstream media to push gun control again. He also wants Biden to twist the arms of the Senate Democrats who voted against this bill the first time. But many ot those Senators are still worried about being reelected in 2014. Obama is sending out Biden to do it. Be concerned when Harry Reid starts devoting Senate time to gun control.

I would feel a bit better about both gun control and immigration reform if I thought I could trust the GOP Speaker of the House John Boehner to push back on these issues and stop them in the House. He has been known to cave easily in the past. What the government should do is leave the law-abiding gun owners alone and go after the criminals and gangs who are using illegal guns to do their crimes and shootings. More gun control laws will not put an end to mass shootings.

At present there is a new form of gun control, since we are now subjected to ammo control through lack of supply courtesy of the Department of Homeland Security buying millions of bullets. This most certainly was according to plan by the Obama administration. Neverr expect Obama to forget about gun control. He will continue to focus on it until he leaves office.

Ann Coulter Hammers GOP Sen. Marco Rubio on Immigration

“This will be a disaster for the Republican Party. The entire country will become California. And Republicans, maybe they’ll have a few good years, but then it will be over and they will never win another national election. Thank you, Marco Rubio.”

Ann Coulter Blasts Immigration Bill And Rubio,
Calls Rubio The Jack Kevorkian Of The Republican Party

Ann Coulter's column this week: If The GOP Is This Stupid, It Deserves To Die

Blog author's comments - I don't agree with many things Ann Coulter says and most of the people she backs or indorses... but she is correct in her assessment of Marco Rubio and the Republican Party. Those of us, who care about what is being done to the country by the Obama administration and the liberals, cannot understand how some members of the GOP don't recognize what they are doing with their push for an amnesty bill for the illegals.

There is polling data that shows the American people want enforcement of the borders first by a 4-to-1 margin before any type of immigration reform bill is discussed. Apparently the 'Gang of Eight' doesn’t agree and they are pushing ahead with their plan. As I see it the Republican Party will lose very little if they don't have the backing of the Hispanic voters because they did not have it in the election of 2012. At least 70 percent of the Hispanic voters are going to vote for the Democrats. If an amnesty bill passes the GOP controlled House it will soon be the end of the Republican Party.

Rubio Called Rush Over Limbaugh Saying He Was 'Disappointed' In Him

Limbaugh: Immigration Bill Designed To Destroy GOP

Rush: I Want To Live In The 'Shadows' Like The 11 Million Illegals

Blog author's comments - I would hope that any immigration reform bill which grants the illegals amnesty and would be an eventual pathway to citizenship...in whatever form it turns out to be...does go down to defeat in the House of Representatives. Yes, the Democrats will use this as a campaign issue in 2014. But the Democrats do not really care about these people except of course as future Democratic Party voters.

The majority of the people who are here illegally have broken our existing laws. Amnesty and eventually citizenship for the illegals will not gain the Republicans anything. Amnesty would be the GOP's ticket to nonexistence. I do not believe that the majority of voters...except of course the low-information voters and hard core liberals...want the illegals to be given amnesty especially without first closing the borders.

IRS Buying Spying Equipment: Covert Cameras in Coffe Trays, Plants

CNS News -- The IRS, currently in the midst of scandals involving the targeting of conservative groups and lavish taxpayer-funded conferences, is ordering surveillance equipment that includes hidden cameras in coffee trays, plants and clock radios.

The IRS wants to secure the surveillance equipment quickly – it posted a solicitation on June 6 and is looking to close the deal by Monday, June 10. The agency already has a company lined up for the order but is not commenting on the details.

“The Internal Revenue Service intends to award a Purchase Order to an undisclosed Corporation,” reads the solicitation.

“The following descriptions are vague due to the use and nature of the items," it says.

“If you feel that you can provide the following equipment, please respond to this email no later than 4 days after the solicitation date,” the IRS said.

Among the items the agency will purchase are four “Covert Coffee tray(s) with Camera concealment,” and four “Remote surveillance system(s)” with “Built-in DVD Burner and 2 Internal HDDs, cameras.”

The IRS also is buying four cameras to hide in plants: “(QTY 4) Plant Concealment Color 700 Lines Color IP Camera Concealment with Single Channel Network Server, supports dual video stream, Poe [Power over Ethernet], software included, case included, router included.”

Finishing out the order are four “Color IP Camera Concealment with single channel network server, supports dual video stream, poe, webviewer and cms software included, audio,” and two “Concealed clock radio.”

“Responses to this notice must be received by this office within 3 business days of the date of this synopsis by 2:00 P.M. EST, June 10, 2013,” the IRS said. Interested vendors are to contact Ricardo Carter, a Contract Specialist at the IRS.

Entire column...
Blog author's comments - I suppose this equipment is for the IRS' 'Covert Operations' division? "If you can’t trust government to follow the Constitution while spying, we’re going to have some problems" ~Barack Hussein Obama. We do have many problems.

The government needs a serious reset. It won't happen with the current administration but constitutional law has to be reinstated. This has gotten insane. The last people you want to see playing covert spy games is the IRS. Are these the same low-level 'rogue' IRS employees who are also being blamed for the targeting scandal? It was not the low-level employees acting on their own in either case.

The question is will America as founded survive the Obama administration? Those who educated themselves concerning Barack Obama prior to the 2008 election knew he would be a failure as president but never thought he would be the complete disaster for the country that he actually is. I suppose Obama knows nothing about the IRS buying spy equipment either.

Mark Levin: 'We Have the Elements of a Police State'

On Fox News Channel’s “Your World with Neil Cavuto,” conservative talk show host Mark Levin reacted to recent revelations that the National Security Agency had been collecting the phone records of millions of Verizon customers.
A Fired Up Mark Levin Talks To Neil Cavuto

The Daily Caller (video & column) -- He said that the NSA news in addition to other openings for intrusion by the federal government are the makings of a “police state.” “I tell you what I make of this — we have the elements of a police state here, and I’m not overstating it,” Levin said. “When you step back and realize the Supreme Court the other day ruled 5-to-4 that law enforcement can take DNA from you even if you’re arrested — by the way, you’re arrested even when you’re stopped for a speeding ticket, and Scalia was right, concerned about a national database. That goes way over the line of our traditions.”

Levin listed the areas where the federal government has the opening to exploit private information through its various agencies under the guises of welfare, law enforcement and national security.

“You look at the Internal Revenue Service, what’s going on there today, and they collect extensive financial and personal information, and they put it on a database,” he said. “This Obamacare is a massive data collection as well of our private personal medical conditions, procedures, drugs, mental, physical illnesses. The Transportation Department, people forget, has proposed black boxes in all of our automobiles to track how they function and how far they go in accidents. We now have domestic drones from EPA to make sure farmers aren’t stepping out of line.”

“The Department of Homeland Security now is checking laptops and iPhones and other data, making copies of it and keeping it, and now we have this,” he continued. “And some of my brothers and sisters in law enforcement, prosecutors, are saying, ‘Look, look, this is permitted. We need to be able to go through and match —’ wait a minute. You don’t throw a whole net on the entire country and everybody’s phone numbers and check the duration and see if you can come up with some overlaps. That’s not law enforcement. That’s not how national security works. I don’t care what the hell the Supreme Court said 30 years ago or what some judge said 15 minutes ago. This is America, and our government is collecting way too damn much data on we the private citizen.”

Entire column...
Blog author's comments - Mark Levin said "we have the elements of a police state here, and I’m not overstating it.” He is correct...the entire infrastructure is already in place...put there by Barack Obama and his corrupt administration. Obama is doing much of what he planned to accomplish when he became president in 2009.

There has to be some limitations as to what Obama can do which is why the Republican Party has to hold the House and attempt to pick up some Senate seats in the midterm elections in 2014. I harped for many months that the election of 2012 was the most important in the history of the United States and I still believe this. But if the Democratic Party wins the House, Obama will again have total power as he did during his first two years in office. Obama will have the chance to do whatever he wants which is why we now have Obamacare.

Gun control is still on the agenda and also immigration reform legislation during his second term. But if the Democrats control the house these will become law and the American people will lose so many of the rights we currently have. The country will never recover.

Why Are Liberals So Rude To The Right?

The Guardian (By Leften Wright) -- Why is it that liberals feel no qualms about being rude? Far too many people who are perfectly polite and courteous, otherwise, think nothing of insulting you for not sharing their political opinions. They look at us with disdain, thinking we're unenlightened conservatives and never hesitating to say so.

As the lone conservative at the tennis courts, I cringe at the Sarah Palin jokes and the jabs at Mormons. When news came on 9/11 that planes had struck the World Trade Center, my partner commented that Bush would use it as an excuse to increase military spending. Bush, of course, is dumb – as are all Republicans, and we're epitomized by Dan Quayle, whose spelling of "potatoe" has entered historical canon. Never mind Obama's telling us there are 57 states, or having a meltdown without a teleprompter. And now it's Marco Rubio, caught drinking water. "Next time he'll forget to zip his fly," joked one of the guys. Mitt Romney changes his mind more often than he changes his underwear. Reagan had Alzheimer's when he made B movies, and Bonzo had to feed him his lines. And would you believe, from a guy with a pathetic serve, this comment about Clarence Thomas, justice of the supreme court: send him back to the plantation.

Liberals have no shame. A dinner guest in our home stood up at the table, clinked his wine glass and said, "It shows how stupid the American people are, they voted for Bush twice." He turned to me, smirking, and said, "I know you voted for him." A biochemist who had been too busy learning liberal doctrine instead of the basic manners of being a guest.[...]

I once called up a friend before a trip down to Florida, and I told him I enjoyed driving and stopping at different places along the way, staying awhile to learn about the country outside of New York. "The red states," he said disdainfully. "Those pickup truck people have a lot of common sense," I said. Click. He had hung up the phone.

Entire column...
Blog author's comments - I think it's because the liberals believe that their world hasn't become utopia yet because of us...the dreaded conservatives. We are keeping the world from being the perfect place. That's why they feel its okay for them to be rude and obnoxious.

They have a superior mindset of I'm smarter and better then you so do and think as I say. The liberals will never admit they're wrong no matter how much evidence is presented to them. They need to put on a display of superiority. They are having a tough time realizing that their socialist agenda is not working. The reality of what our founding fathers put forth is the only way this country will not only survive, but to be great again. This is not what they believe and have been told by their Democratic Party elected officials and president.
